COURSE DESCRIPTION

The course will examine the emerging and growing body of law relating to the Internet.  The sources of Internet law are many, from intellectual property to tort to privacy law. Given the newness and complexity of this technology, special attention will be paid to the application of existing laws and models to cyberspace and how technology is challenging settled legal understandings. Class discussions will consider, among other issues and policy discussion, practical approaches to current problems and the business issues faced by clients. Over the sessions the professor intends to cover

I.         IDEAS AND THEIR PROTECTION: What is Public and What is the Public Domain? 

II.        DOMAIN NAMES:  Ownership, Control, and Protection (in the US, in the EU, and Elsewhere)

III.       TRADEMARKS:  Creation, Registration, Policing and Enforcement (Generally and Against Domain Squatting)

IV.       COPYRIGHT: Creation, Registration, Enforcement & "Fair Use" (Generally and Under Free Speech Principles)

V.        DATA COLLECTION AND PRIVACY:  U.S. & E.U. Regulations and Waivers Under Written "E-Agreements" 

VI.       ELECTRONIC CONTRACTS: E-Signature Laws in the U.S., in the E.U. and Internationally

VII.      SPAM, ADVERTISING AND SPYWARE

Also available for advanced law students and for internet entrepreneurs looking for a legal background. Prior courses in IP law helpful, but not required.
