This is a one credit course in the Pericles LL.M. program. The course has an exam after the end of the course. To pass the course you should not miss more than one of the four classes.
The law of security and guarantees is complex and contains many traps for lawyers, and the right legal advice can determine whether a creditor is able to successfully realise value from his security and guarantee package. This course will examine the role of security and guarantees in international financings. It will compare the treatment of security and guarantees under English, New York, Russian and other legal systems, and examine how the law gives special rights (and duties) to creditors who benefit from security and guarantees. After taking the course, students should be able to better understand how security and guarantees improve (or don’t improve) a creditor’s legal position, and be able to advise clients on optimal structures for achieving a stronger financing.
